EPA also found that the developers had discharged water used in the construction into the stormwater sewer system without the proper permit.

CWA violations: The manufacturer exceeded its pretreatment permit discharge limits for lead and copper for at least 52 months, including 84 monthly average violations and 6 violations of daily maximum limits.

CWA violations: According EPA, the Salt Lake facility had difficulty consistently complying with the selenium limit in its permit to discharge to the Central Valley Water Reclamation facility. The company’s auditor discovered that the facility had exceeded its permit limit for selenium and that employees had screened samples before submitting them to an outside laboratory for analysis.
Penalty: $3 million fine
