What are the initial notification requirements for existing and new RICE engines under the RICE NESHAPs regs 40 CFR 63?

Initial notification requirements for the following under 40 CFR 63 Subpart ZZZZ–National Emission Standards For Hazardous Air Pollutants For Stationary Reciprocating Internal Combustion Engines are as follows:

  • Existing RICE with a site rating of more than 500 brake HP: Per 40 CFR 63.6645(b), if you started up your stationary RICE with a site rating of more than 500 brake HP located at a major source of HAP emissions before August 16, 2004, you were required to submit an Initial Notification not later than December 13, 2004.

  • Existing RICE with a site rating equal to or less than 500 brake HP: Per 40 CFR 63.6645(d), if you started up your stationary RICE with a site rating equal to or less than 500 brake HP located at a major source of HAP emissions before March 18, 2008, you were required to submit an Initial Notification not later than July 16, 2008.
  • New RICE with a site rating of more than 500 brake HP: Per 40 CFR 63.6645(c), if you start up your new or reconstructed stationary RICE with a site rating of more than 500 brake HP located at a major source of HAP emissions on or after August 16, 2004, you must submit an Initial Notification not later than 120 days after you become subject to 40 CFR 63 Subpart ZZZZ–National Emission Standards For Hazardous Air Pollutants For Stationary Reciprocating Internal Combustion Engines (40 CFR 63.6580 to 63.6675).
  • New RICE with a site rating equal to or less than 500 brake HP: Per 40 CFR 63.6645(e), if you start up your new or reconstructed stationary RICE with a site rating equal to or less than 500 brake HP located at a major source of HAP emissions on or after March 18, 2008, you must submit an Initial Notification not later than 120 days after you become subject 40 CFR 63 Subpart ZZZZ–National Emission Standards For Hazardous Air Pollutants For Stationary Reciprocating Internal Combustion Engines (40 CFR 63.6580 to 63.6675).

Initial notifications are required to contain the following information per 40 CFR 63.9(b)(2):

  • The name and address of the owner or operator;
  • The address (i.e., physical location) of the affected source;
  • An identification of the relevant standard, or other requirement, that is the basis of the notification and the source’s compliance date;
  • A brief description of the nature, size, design, and method of operation of the source and an identification of the types of emission points and types of hazardous air pollutants emitted; and
  • A statement of whether the affected source is a major source or an area source.
