In the final stages of a very busy summer, the EPA released its newly proposed regulations for hazardous waste generators. These rules are designed to address generator-specific requirements, correct technical errors, and reorganize the generator rules at 40 CFR 261.5 to make them easier to read.
The current Resource Conservation and Recovery Act (RCRA) regulations governing hazardous waste generators were written in 1980, and since then, the EPA has been made aware of “ambiguities, inconsistencies, gaps, and a lack of flexibility in the regulations,” which have limited the effectiveness of the requirements to protect human health and the environment. In a new proposal, the Agency says it is attempting to correct at least some of those drawbacks to improve the usability of the regulations by the regulated community.
