HAZWOPER: Who’s Covered? What’s Required?

HAZWOPER (hazardous waste operations and emergency response) standards cover employers with one or more employees who engage in any of the following operations:

  • Cleanup operations required by federal, state, or local governments at uncontrolled hazardous waste sites where an accumulation or suspected accumulation of hazardous substances creates a threat to the health and safety of people or the environment (all parts of 29 CFR 1910.120 and 29 CFR 1926.65 except sections (p) and (q))
  • Corrective actions involving cleanup at RCRA-regulated sites (all parts of 29 CFR 1910.120 and 29 CFR 1926.65 except sections (p) and (q))
  • Voluntary cleanup at government-recognized uncontrolled hazardous waste sites (all parts of 29 CFR 1910.120 and 29 CFR 1926.65 except sections (p) and (q))
  • Treatment, storage, and disposal of hazardous waste at TSDFs licensed under RCRA (29 CFR 1910.120(p) and 29 CFR 1926.65(p) only)
  • Emergency response operations for release, or substantial threats of release, of hazardous substances (29 CFR 1910.120(q) and 29 CFR 1926.65(q))
  • State and local government employees engaged in hazardous waste operations in states that are not covered under OSHA rules (40 CFR 311.1 and 40 CFR 311.2)

If an operation is not covered by the operations listed above but is capable of releasing a hazardous substance, it must comply with the HAZWOPER emergency response requirements (29 CFR 1910.120(q) and 29 CFR 1926.65(q)), including employee training.

HAZWOPER rules for general industry and construction are identical.

  • Operations conducted under RCRA (1910.120(p) and 1926.65(p))
