Prohibited Act Penalties
Wastewater: Violations of rules and general requirements Civil:
33 USC 1319(d):
Up to $37,500
Wastewater: Class I violation Section 309(g) Administrative:
33 USC 1319(g)(2)(A):
Up to $16,000 per day per violation, not to exceed $37,500
Wastewater: Class II violation Section 309(g) Administrative:
33 USC 1319(g)(2)(B):
Up to $16,000 per violation per day, not to exceed $177,500
Wastewater: Negligent wastewater discharge violations Criminal:
33 USC 1319(c)(1)(B):
Up to $25,000 per day per violation and/or up to 1 year’s imprisonment; penalties and prison time double for subsequent violations.
Wastewater: Knowingly committing a wastewater discharge violation Criminal:
33 USC 1319 (c)(2)(B):
Up to $50,000 per day per violation and/or up to 3 years’ imprisonment; fines and prison time double for any subsequent violations
Wastewater: Intentional violation, or risking life or bodily harm of another person from a wastewater discharge Criminal:
33 USC 1319(c)(3)(A):
Up to $250,000 and/or up to 15 years’ imprisonment; a convicted corporation or organization faces up to $1 million; fines and prison time double for sub- sequent violations
Wastewater: False statements concerning CWA documents Criminal:
33 USC 1319(c)(4):
Up to $10,000 and/or up to 2 years’ imprisonment; fine and prison time double for subsequent violations
