Q. Can a Hazardous Waste determination be made for dust waste using only the Kst value (ASTM Standard Test Method E 1226)?
A. The ASTM Standard Test Method E 1226 cannot be used to make a hazardous waste determination, either alone or as an alternative to other tests. EPA does not cite it as a test to use for determining either the hazardous waste characteristic of ignitability at 40 CFR 261.21 or for determining the hazardous waste characteristic of reactivity at 40 CFR 261.23 (the characteristics most likely to be associated with a potentially combustible waste). Those regulations do specify the tests that EPA requires be used.
